Hello, My name is angela, and i live in SF New Mexico, and i was wondering if a 16 year old, simply kissed a 21 year old would that be considered statutory rape in New Mexico?. I just mean little pecks, and possibly some tounge thrown in (I don't mean a big passionate, wandering hands, groping, intimate, kiss). I'm pretty sure it's only if you have sex with someone under age, but does that also go for dating/kissing/holding hands? if a 16 year old dated a 21 year old is that statutory rape in New MExico? please help! thanks! :confused:

      Yes, anybody can file a report with the police.

    • Isn't this statutory rape?we live in Tennessee,I am a concerned parent and grandparent,but these parents know this is going on right under their roof.They also have small children in the househod as well.

    • Kissing is not statutory rape, but depending on the type of conduct, whether it is public and the overall situation, some kinds of kissing could be lewd and lascivious conduct with a minor and some places are prosecuting that. SO be careful how, where and who knows about kissing, as well as the kind of kissing and its locations.

      If its truly just a few little pecks then you dont have much to worry about (but frankly, most quick pecks don't involve tongue action). Just remember---what starts out as little pecks often leads to much more. Holding hands is also nothing to be concerned about.

      A 16-year-old--if their parents allow it--can date a 21-year-old, but if they have sex, it's a felony.
